Acceptable Use Policy
Effective 1 October 2026. This policy is part of the Terms of Service. It applies to everyone who uses NectarScout, which The Hashtag Crew operates, including your team members. "You" means the customer and anyone using your account.
Our customers share the platform, its sending reputation and its standing with email providers. One account that sends spam or breaks the law can harm all of them. That is why we enforce this policy.
1. You are the sender
Emails go out from your mailboxes, under your name, to people you choose. Calls are made by your team. You are responsible for every message and call, and for complying with the law of each country where the person you contact is based. The platform's compliance checks are guidance to help you, not legal advice and not permission.
2. Email rules you must follow
Every commercial email you send must:
- say who it is from truthfully, with an accurate From name, address and subject line;
- include your real postal address, which the platform adds from your Branding settings;
- offer a working way to opt out, which the platform adds to every message (the "unsubscribe" option in the recipient's email app), and you must not remove or hide it;
- stop when someone says stop. The platform blocks further email to a person who unsubscribes or asks not to be contacted. You must also honour opt-outs that reach you any other way, within 10 business days at most, and never remove someone from the block list unless they have genuinely asked to hear from you again.
Some countries need more than this:
- United States (CAN-SPAM): the rules above.
- United Kingdom (PECR) and the EU (ePrivacy laws): you may email a company's general or role address, and in the UK an employee of a company, if the message is relevant to their job and they can opt out. You need prior consent to email a sole trader or an individual (in the UK, a sole trader or a partnership).
- Germany: email marketing to businesses generally needs prior consent (UWG section 7). The platform cannot record consent, so it blocks these sends. Do not get round the block.
- Canada (CASL): you need consent. Implied consent can come from a business address that was published openly, with no statement that it does not want marketing, where your message is relevant to the person's role.
- Australia (Spam Act 2003) and New Zealand (UEMA 2007): you need consent, which can be inferred from an address published openly where the message is relevant to the person's role.
- Other countries: follow the local law. If you are not sure, do not send.
3. Telephone rules you must follow
If you call people using the platform or a connected phone system, you must:
- check and respect do-not-call registers where they apply, such as the US National Do Not Call Registry, the UK Telephone Preference Service and Corporate TPS, Canada's National DNCL and Australia's Do Not Call Register;
- follow the rules on automated dialling, pre-recorded messages and text messages, such as the US Telephone Consumer Protection Act;
- tell people at the start of a call if it is being recorded, and get consent where the law requires it. Some places, including several US states, need the consent of everyone on the call;
- call only at reasonable times in the other person's time zone.
4. Prohibited uses
You must not use the platform to:
- send email to lists you bought, rented or collected outside the platform, or to addresses that have opted out;
- send spam, chain letters, or messages that are misleading about who you are, why you are writing or what you are offering;
- impersonate any person or business, or present a website preview as the business's real website or as something it has approved;
- publish a website preview anywhere public, or show it to anyone other than the business it was made for;
- harass, threaten or defame anyone, or send hateful, sexually explicit or violent content;
- promote anything illegal, or contact people about regulated products (such as financial services, gambling, weapons, drugs or adult content) in breach of the rules for them;
- collect special category data (such as health, religion, sexual orientation or political views), or data about children;
- break the rules of the websites and services the platform reads, beyond normal use of the platform's own features;
- infringe anyone's copyright, trademark or other rights;
- pretend that an AI chat or AI-written message is a human when someone asks, or where the law requires you to say;
- get round sending limits, plan limits, suppression lists, compliance holds or security measures;
- send malware, probe or attack the platform, or try to access another customer's data;
- resell or share access to the platform outside your organisation, unless we have agreed in writing;
- use the platform if you are subject to sanctions, or to contact anyone in a sanctioned country.
5. Website previews
A website preview made with the platform uses the business's public information, logo and images to show them what a new website could look like. It is a private sales sample for that business only. Previews are marked so search engines do not list them. If the business or the owner of any content asks you to take a preview down, you must do so promptly. You can delete it in the platform.
6. Healthy sending
To protect deliverability for everyone:
- warm up new mailboxes gradually, and stay within the daily limits the platform sets;
- keep your bounce rate low and remove addresses that bounce;
- keep spam complaints below 0.3% (Google and Yahoo's limit for bulk senders) and aim for under 0.1%;
- set up SPF, DKIM and DMARC on the domains you send from.
7. What we do if this policy is broken
We may, depending on how serious the problem is and whether it keeps happening:
- warn you and ask you to fix it;
- pause sending or other features for your account;
- suspend or close your account, as set out in the Terms;
- report illegal activity to the authorities.
Where we can, we will warn you first. We may act without warning when there is a risk of harm to people, to other customers or to the platform.
8. Reporting abuse
To report spam, abuse or content that infringes your rights, email hello@nectarscout.com with the message or link and what is wrong. We look at every report.
